Sidewalk repair and tree roots

At Tuesday's KPNA meeting there were questions about sidewalk repairs. A KP neighbor called Jacob Ryg, city forester at the Parks Department for more info. She sends along the following:

Basically, the city has a new policy regarding sidewalk repairs due to tree root uplift. The old policy was to grind the tree and the new policy is to dig deep and do a backfill with aggregate.

Here are my questions and here are the responses.

1 - How is it determined if my sidewalk damage is caused by tree roots?
1. It may be difficult to be certain if the tree caused the damage to the sidewalk, but if the sidewalk is uplifted, it is likely. Also, once the sidewalk panel is removed, the tree roots should be move apparent. These roots should be cleanly ground to a depth of 6 inches below the bottom of the sidewalk before the sidewalk is replaced.

2 - We had a contractor lined up to fix our sidewalk because we also wanted our front steps fixed, but if I read the Request correctly, only the city's contractor would be able to do the work. Is that correct?
2. Any licensed sidewalk contractor is permitted to complete this work. We encourage all contractors to follow the new process of remove 6 inches of soil from under the removed sidewalk panel (which are near the tree) and then backfill this area with the 1-inch clean aggregate material.

3 - The city will pay for the new technique, but we are still responsible for the cost of the sidewalk?
3. The tree root grinding is a long standing requirement and is the property owner's obligation. The city will not reimburse you or your contractor for any additional cost to follow the new aggregate placement process, but will not pass along any additional costs that the city's contractors may charge to the city.

Sounds like if the city does the work, the homeowner won't be charged for the "extra" cost incurred. Also, according to the Council Action, "The City will be responsible for the entire cost for any subsequent sidewalk repairs at these locations if the new sidewalk repair technique is utilized." Not clear if this is only for work done by the city or private contractors as well.

lots of good ideas!

This is a 4-plex that many of us have been watching go up for some time. It's a First Homes project and the first new housing built in the neighborhood in years.
